These pages are starter content for a youth-sports athletic-injury platform. Real deployment requires customization by a qualified attorney for your jurisdiction, your school district's legal posture, the actual subprocessors you've signed agreements with, and the specific risks of your operation. Atlerts (the software) does not constitute legal advice.
Atlerts is a product of Bridgelines Inc., a Delaware corporation. On this page, “Atlerts” and “the Service” mean the software, and “we”, “us” and “our” mean Bridgelines Inc. — the company that provides it and the party to any agreement with your school.
The Family Educational Rights and Privacy Act (FERPA) gives parents and students who are 18 or older (“eligible students”) certain rights with respect to the student's education records. The athletic and health records maintained on this Service are educational records under FERPA when held by the school.
Right to inspect and review
Parents and eligible students have the right to inspect and review the student's education records within 45 days of the day the school receives a request. Use the “Download record” button on the athlete's dashboard for an electronic copy. To request a paper copy or to inspect records in person, contact your school's FERPA officer or athletic director.
Right to request amendment
Parents and eligible students have the right to request the amendment of records they believe are inaccurate, misleading, or in violation of the student's privacy rights under FERPA. Requests should be in writing, addressed to the school official responsible for the record, and clearly identify the part of the record they want changed and why it should be changed. If the school decides not to amend the record, the school will notify the parent or eligible student of the decision and of the right to a hearing.
Right to consent before disclosure
Parents and eligible students have the right to provide written consent before the school discloses personally identifiable information (PII) from the student's education records, except to the extent FERPA authorizes disclosure without consent. Common exceptions include disclosures to school officials with legitimate educational interests, to officials of another school in which the student seeks to enroll, to authorized representatives of state and federal education agencies, in connection with financial aid, in compliance with a court order or lawfully issued subpoena, and to appropriate parties in a health or safety emergency.
Directory information
FERPA permits a school to designate certain information as “directory information” (for example, name, sport, year of graduation, height/weight for athletic rosters) that may be disclosed without consent unless the parent or eligible student opts out. Your school's directory information policy and opt-out procedure should be set out in the school's annual FERPA notice. Atlerts does not publish directory information externally on the school's behalf without explicit configuration.
Right to file a complaint
Parents and eligible students have the right to file a complaint with the U.S. Department of Education concerning alleged failures by the school to comply with FERPA:
Family Policy Compliance Office
U.S. Department of Education
400 Maryland Avenue, SW
Washington, DC 20202
Annual notification
The school is required to notify parents and eligible students annually of their rights under FERPA. This notice supplements the school's annual notification.
